Definitions:
- Client: The company or individual requesting services from Pixld.
- Pixld: Primary designer/site owner and employees or affiliates.
General:
- Pixld will perform work based on an agreement provided by email, telephone, or mail.
- Pixld will work only for clients who are 18 years of age or older.
- An ‘order’ is considered a contract between Pixld and the client, including agreements made via telephone, text, and email.
Website Design, Development, and Hosting:
- Pixld endeavors to ensure websites and scripts are free of errors but cannot accept responsibility for losses due to website malfunctions.
- Websites, domain names, graphics, and programming code remain the property of Pixld until all accounts are paid in full.
- Scripts and software developed by Pixld are copyrighted by Pixld and cannot be reproduced without permission.
- Pixld cannot take responsibility for copyright infringements caused by client-submitted materials.
- Additions to the project brief will be at Pixld's discretion and may incur additional charges.
Limitation of Liability:
- Nothing in this Agreement shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited or excluded by applicable law.
- Subject to applicable law, neither party shall have liability to the other party for any indirect or consequential loss.
- Pixld’s total liability to the Client shall be limited to 50% of the total Charges paid by the Client under this Agreement.
- The Client’s total liability to Pixld shall be limited to 80% of the total Charges paid by the Client under this Agreement.
Nondisclosure:
- Pixld agrees not to disclose any confidential information during or after the term of this agreement unless directed by the Client.
- The Client agrees not to disclose any confidential information about Pixld to another party.
Privacy Policy:
- Pixld shall use client-provided information in accordance with the EU General Data Protection Regulation (GDPR) and national laws implementing GDPR.
- All personal data shall be processed lawfully, fairly, and transparently for specific purposes.
- For email tracking, Pixld uses Mailtrack for project management and sales follow-ups.
Interpretation:
- Pixld reserves the right to terminate a project with a Client at any time without prior notification if the Client breaches these terms and conditions.
- This agreement shall be governed by Irish law with exclusive jurisdiction of the Irish Courts.
- If any term of this contract is void or unenforceable, the remaining terms shall remain valid and enforceable.
- Pixld reserves the right to alter these Terms and Conditions at any time without prior notice.
Acceptance:
- By accepting a quotation or making a payment of invoice, the Client acknowledges reading, understanding, and accepting these Terms and Conditions.
